Landlord Checklist

A. Leasehold Property
Prior to letting Leasehold premises, you should ensure that there are no restrictions or covenant which prevent sub-lets or regulations Tenant(s) must adhere to during the tenancy period. Written consent or a licence must be obtained where necessary.

B. Mortgages
You should notify your Building Society or Bank if the property is mortgaged to obtain permission to sub-let. They will usually want sight of the contract to be used and we will of course provide copies of the Tenancy Agreement and relevant notices.

C. Insurance
We strongly advise that you contact your building and content insurers and notify them of your intention to let the premises as they may need to alter your policy to cover a third party residing at the property.

D. Income Tax
Landlords who reside outside the UK and those who live in the UK and subsequently move abroad are bound under the Taxes Management Act 1970, Section 78 and 83. TMD Properties are able to supply you with the necessary forms which will negate the need for us to withhold monies from rent collected on behalf of the Inland Revenue. We must, however, receive written notice from the Inland Revenue giving permission. We would strongly advise you to appoint an accountant or tax adviser who will be able to advise you further of any such liabilities.

E. Gas Safety (Installation and Use) REGULATIONS 1994 (1996)
Under this legislation all Landlords are required to have gas appliances in a let property serviced annually by a British Gas or CORGI registered engineer. Any items that fail to comply with the regulations must be fixed or removed immediately. A record of such servicing is to be kept and this information must be produced to the Tenant(s) upon request.

F. Furniture And Furnishing (Safety) Regulations 1988 (1993)*
These regulations state that all soft furnishings supplied in a let property must meet the official fire resistance standards by containing a permanent attached label confirming that it applies. These checks are carried out by the inventory clerk.

G. Electrical Equipment (Safety) Regulations 1994*
All electrical equipment supplied as part of a furnished accommodation under the Consumer Protection Act 1987, must comply with the regulations and be 'safe' and of no risk or injury to human or animal. The Plugs and Sockets (safety) Regulations 1994 further require that plugs have the correct fuses fitted. A qualified N.I.C.E.I.C. electrician is required to carry out these checks and complete any necessary work required to comply with the regulations. Good practice would be to carry out these tests annually.

H. Post
The Post Office offers a service to re-direct your mail which we recommend you arrange prior to vacating the property for the term of the tenancy. You should also inform your bank, employers, friends and family of your new address. TMD Properties will not be held responsible for collecting and forwarding mail, however, we will deal with any stray letters when brought to our attention.

I. Council Tax
From April 1993 Council Tax is the responsibility of the Tenant(s) during the tenancy. Please advise the Local Authority the date of transfer to the new Tenant(s) and of your forwarding address in order that they can send you a closing account.

J. Keys
It is important to have several keys cut for the property; enough for each adult Tenant due to move into your property plus a set for our Management Department (if applicable) for security and access if so required.

K. Legal Costs
Should there be at any time any need to take legal action against the Tenant(s) for what so ever reason the Landlord will be responsible for this action plus any necessary costs incurred. For managed properties assistance will be given to the Landlord with regards to documentation and administration with reference to the tenancy.
